Open Space, Sport and Recreation Supplementary Planning Document (SPD)

The Forest Heath District Council Open Space, Sport and Recreation Supplementary Planning Document (SPD) was adopted at planning committee on the 24th August 2011, and will be implemented on the 1st October 2011. The SPD sets out the District Council’s approach when considering planning applications for new residential development which is likely to generate demand for, access to and use of open space and recreation facilities. The Document now forms part of the up-to-date Development Plan for Forest Heath.

The implementation of the SPD requires compliance with a unilateral Undertaking. When using this Unilateral Undertaking, it should be signed and submitted with the planning application to comply with the policy requirement for Public Open Space, where the Public Open Space is not provided on site. A fee of £810 is also required, which comprises £300 towards the Councils Legal costs and a £510 Monitoring Fee. If the planning application is refused, we will refund £760, retaining £50 for administration costs. On sites where part or all of the Public Open Space can be provided on site or where larger developments are involved, a legal agreement made under Section 106 of the Town and Country Planning Act 1990 can be agreed to secure the provision of Public Open Space, instead of this Unilateral Undertaking.
