Enforcement is an important part of the development control framework. As Local Planning Authority (LPA), we have the power to take action against breaches of planning control where, for example, development occurs without the benefit of permission or fails to comply with a planning permission.
We also have powers to take action against unauthorised works to protected trees, such as those in conservation areas, and listed buildings.
A breach of planning control may be a criminal offence and the powers to take enforcement action are discretionary and based on the principle of expediency. Action will normally only be taken where a breach is considered unacceptable and harmful to public amenity or where it is in the public interest.
