Car Boot Sales held on Council Owned Land (George Lambton
Playing Fields)
- Applications to hold a sale will only be approved from
charitable, sporting or community organisations, where the purpose
is to raise funds for the organisation.
- Access for the use of George Lambton Playing Field will be
subject to prior completion of an application form. Such a form
will be prepared and provided by Newmarket Leisure Centre,
including the appropriate Conditions of Hire. No access will be
permitted until approval has been given to the application.
- It is also a requirement that organisations have Public
Liability Insurance to cover the event. The Council's policy is to
have at least £5,000,000 cover. The organisers are required to
forward a copy of the certificate with the application
form.
- All applicants that meet the criteria are offered one place,
date unspecified, with all names 'going into a hat'. Any remaining
places will then be put into a second round for those who are
unsuccessful and/or require a second date.
- Each approved car boot will be limited to a maximum 100
cars/pitches and each and every trader shall sell or display only
articles surplus to their own domestic requirements usually
described as jumble or bric-a-brac including books, records, small
second hand domestic furniture and equipment etc. Traders selling
new items and goods brought in for resale including any of the
above similar items will not be permitted. Follow

- Should you allow a food vendor onto the site you must ensure
they have exercised all due diligence to ensure the safety of any
food or drink they bring on to the site. You can achieve this by
ensuring they are registered with the local authority and obtaining
a copy of the registration document before allowing them to trade.
Any person selling food may be required to
register as a food business.
- There is a minimum fee for each sale (irrespective of the
number of cars attending). A deposit of £50.00 will also be
required.
- Organisations will need to arrange with Newmarket Leisure
Centre the collection of the key to enable entry onto the fields, a
refundable deposit of £5.00 will be required upon collection of the
keys.
- The Council reserves the right to refuse permission to hold a
car boot sale on the grounds that it is likely to detrimentally
affect the legitimate markets and fairs of the area or is
unnecessary or undesirable for any reason.
- The organiser shall not cause or permit any noise or nuisance
to the residents in the neighbourhood of the sale.
- The site of the sale and all roads must be left in a clean and
tidy condition and free from litter immediately after the close of
the sale.
- Organisations must ensure that there are enough stewards to
manage and control the public and vehicular access to the site. A
height barrier is in operation at the site and should be kept
locked when not in use.
- The organiser shall not cause or permit notices or posters
advertising the car boot sale to be displayed on lamp posts,
buildings etc, without the permission of the owners of those
premises or in contravention of the Planning
Legislation.
- Car Boot Sales will take place on Sundays during the period
May - August each year.
- The Council will limit an organisation to a maximum of 2 events
per year.
- Consent will not be granted for future sales to any person or
organisation that breaches any of these conditions.
Car Boot Sales held on privately owned land
- All Car Boot Sales must comply with planning requirements. This
means that unless the land has planning permission for use for such
sales, it must not breach the provisions of the Town and Country
Planning (General Permitted Development) Order 1995. In summary
this means that a sale may be held on, up to 14 days in a year as a
temporary use. (It is recommended that detailed advice is sought
before taking any action as the above is only a
summary).
- The holder of the sale must give a minimum of one month's
notice to the Council of all such sales. It is an offence not to
give the notice and both the organiser and the owner of the land
may be liable to a maximum fine of £1,000 (Section 37 Local
Government Miscellaneous Provisions Act 1982) this provision does
not apply to events where the proceeds are to be applied solely or
principally for charitable, social, sporting or political
purposes.
